Vehicle Turnaround Damages Development Land

OFFER: $8,046 . . . JURY VERDICT: $145,876

After the Take, we argued that the condemning agency overlooked damages to the 4.5 acre property caused by the road project, including:

  1. The Driveway Access will be limited to a small area on the west side of the property;
  2. A Vehicle Turnaround is carved into the property frontage, limiting driveway access;
  3. The roadway is widened from a 2-lane road to a 5-lane road, with a Vehicle U-Turn Bulge sticking into the property’s frontage;
  4. A new 2 foot x 4 foot concrete box culvert will dump stormwater runoff off the widened road pavement onto and across the property;
  5. Permanent Slopes will be created along the property’s frontage.

THE JURY VERDICT WAS 17.6 TIMES MORE THAN THE ORIGINAL OFFER
