BEFORE THE TAKE
Before the Take, the large property had unobstructed access along KY 465, and was in 2 large, rectangular parcels. The property was adjacent to Interstate 71, and had good visibility and exposure from I-71. The existing use of the property was farming tobacco. The government claimed that the existing use of the property was farming and we provided evidence that the highest and best use was a commercial use.

AFTER THE TAKE
We demonstrated to the jury that the circular ramps placed over part of the property, caused the remaining property:

  • to have an irregular shape,

  • increased the cost to develop the remaining property,

  • and made the property less valuable for future development.

THE VERDICT WAS OVER $900,000 MORE THAN THE ORIGINAL OFFER
